Welcome to Hidaya! Please read these Terms & Conditions carefully—they form a binding contract between you and the company that owns and operates Hidaya (referred to here as "Hidaya," "we," "our," or "us"). If you do not agree, you may not access or use the Services.
1. Who We Are
Our mission is to provide a reliable, user-friendly tool that helps you deepen your relationship with Allah. Through the Hidaya mobile application and website (collectively the "Services") you can, among other things:
- Track and perform daily prayers and adhkār
- Discover Qur'anic people, places, and themes
- Consult Qur'an verses and authentic ḥadīth
- Ask faith-related questions and receive AI-generated responses grounded in Islamic sources
- Please remember that all answers and "Outputs" are generated by artificial-intelligence systems and should not replace qualified scholarly advice.
2. Scope & Agreement
These Terms, together with any additional terms we present for particular features ("Additional Terms"), make up the entire agreement between you and Hidaya concerning the Services. If Additional Terms conflict with these Terms, the Additional Terms govern for the relevant feature.
3. Changes to Terms or Services
We may update these Terms or modify/withdraw any part of the Services at our sole discretion. Material changes take effect 30 days after we notify you (e.g., by email, in-app pop-up, or push notification). Your continued use after the effective date constitutes acceptance. If you disagree, stop using the Services before the change takes effect. Our liability for discontinuing the Services is limited to any pre-paid, unused subscription fees where required by law.
4. Eligibility & Accounts
- You must be 18 years or older (or the age of majority where you live) to create an account ("Member"). If you are a parent/guardian allowing a minor to use your account, you accept full responsibility for the child's activities.
- You agree to:
- Provide accurate, current information;
- Keep your log-in credentials secure; and
- Notify us immediately of any unauthorized use.
5. Subscriptions & Purchases
- Trial Periods & Auto-Renewal. Trials convert to paid plans unless you cancel at least 24 hours before trial expiration. Subscriptions renew automatically.
- Billing. Fees are charged to your Apple App Store, Google Play, or Stripe account no earlier than 24 hours before renewal.
- Cancellation. Cancel in your App Store/Play Store settings or in the Hidaya app ≥24 hours before the next renewal to avoid further charges.
- Refunds. Except where local law or platform rules grant a statutory right of withdrawal, all fees are non-refundable.
6. License
Subject to these Terms and your active subscription, Hidaya grants you a personal, non-exclusive, non-transferable, revocable license to access and use the Services. Hidaya and its licensors retain all other rights, title, and interest.
7. User Content & Outputs
- User Content. Any text, images, or data you provide remains yours—but you grant Hidaya a worldwide, perpetual, royalty-free license to use it (and derivatives) to operate, improve, and commercialize the Services, including AI-model training.
- Outputs. AI-generated responses belong to Hidaya. You may use them for personal, non-commercial purposes, subject to these Terms.
- Removal. We may remove or refuse User Content that violates these Terms or applicable law.
8. Third-Party Services
The Services may integrate or rely on third-party platforms, APIs, or open-source components ("Third-Party Services"). Your use of those services is governed solely by their terms, and Hidaya is not liable for any Third-Party Services.
9. Acceptable Use
- You agree NOT to:
- Upload content that is unlawful, harassing, defamatory, obscene, hateful, or infringes others' rights;
- Reverse-engineer, scrape, or circumvent security features;
- Resell, sublicense, or exploit the Services commercially;
- Use Hidaya for scientific evaluation or benchmarking without written consent;
- Violate any export-control, data-protection, or anti-spam laws.
10. Assumption of Risk
Hidaya is not a substitute for professional religious, medical, or mental-health advice. Use the Services at your own discretion and risk.
11. Indemnity
You will defend, indemnify, and hold harmless Hidaya and its affiliates, officers, employees, and partners from any claims or losses arising out of: (a) your use of the Services, Outputs, or Third-Party Services; (b) User Content; or (c) your breach of these Terms or applicable law.
12. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." Hidaya disclaims all warranties—express, implied, statutory, or otherwise—including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the Services will be uninterrupted, secure, or error-free.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIDAYA AND ITS PARTIES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID HIDAYA IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US $100.
14. Termination
- By Us. We may suspend or terminate your access at any time for breach, legal compliance, or to protect users.
- By You. You may delete your account and cease using the Services at any time.
- Upon termination, all licenses end and we may delete your data.
15. Feedback
Any feedback you provide is non-confidential, and you grant Hidaya a perpetual, worldwide, royalty-free license to use it in any manner.
16. Illegal Content Notices
If you believe content on Hidaya is illegal or infringes your copyright, please email spotcalendars@gmail.com with the details listed in Section 16 of the original Terms (DMCA or EU DSA format). We will respond as required by law.
17. Governing Law & Dispute Resolution
Except where prohibited by local law, these Terms are governed by the laws of New York state, without regard to conflict-of-law rules. Disputes must be resolved first through good-faith negotiations (90 days) and, if unresolved, exclusively in the courts located in New York State. You waive trial by jury and any right to participate in class actions, to the fullest extent permitted by law.
18. General
- Assignment. Hidaya may assign its rights at any time; you may not without our consent.
- Force Majeure. We are not liable for events beyond our reasonable control.
- Severability. If any provision is found unenforceable, the remainder remains in effect.
- Notices. Email us at spotcalendars@gmail.com. We will email you at the address associated with your account or provide in-app notice.
19. Acceptance
By creating an account or using Hidaya, you confirm that you have read, understood, and agree to ALL provisions of these Terms, including, without limitation, Sections on Assumption of Risk, Disclaimers, Indemnity, Limitation of Liability, Acceptable Use, Governing Law, and Termination.

International Transfers
Your data may be processed in countries outside your own (including the US and EU). When we transfer Personal Information internationally, we rely on: • European Commission adequacy decisions (for EU transfers); • Standard Contractual Clauses or UK Addendum; or • Your explicit consent, where required.
Data Security
We apply reasonable administrative, technical, and organisational measures—such as encryption in transit and at rest, access controls, and ongoing monitoring—to safeguard Personal Information. No method of transmission or storage is ever completely secure; therefore, we cannot guarantee absolute security.
Data Retention
We keep Personal Information only as long as necessary to achieve the purposes described above, to comply with legal obligations, or to resolve disputes. Usage data linked to your account is typically retained for the life of your account and deleted or anonymised within five years after closure, unless a longer period is legally required or justified by our legitimate interests (e.g., fraud prevention).
Children
Hidaya is intended for users 18 years of age or older. We do not knowingly collect Personal Information from children. If we learn that we have done so, we will delete it.
Your Privacy Rights
- Depending on your jurisdiction, you may have the right to:
- Access, correct, or delete Personal Information;
- Withdraw consent or object to processing (e.g., direct marketing);
- Restrict processing or request data portability;
- Opt out of the sale or sharing of Personal Information or of targeted advertising;
- Lodge a complaint with a supervisory authority;
- Appeal any refusal of your request.
